TAMA 38 – Strengthening or Rebuilding Individual Buildings

TAMA 38 was created to protect buildings from earthquakes. It applies to buildings built before 1980 that don’t meet today’s safety standards. Instead of making homeowners pay for upgrades, developers do the work in exchange for permission to build and sell extra apartments.

There are two types of TAMA 38 projects:

1. TAMA 38/1 – Strengthening an Existing Building

  • The old building remains, but it gets reinforced to withstand earthquakes.
  • Apartments may be expanded, often adding saferooms (“mamad”), balconies, elevators, and sometimes parking spaces.
  • Residents stay in their apartments during construction, which can be noisy and inconvenient.

2. TAMA 38/2 – Demolish and Rebuild

  • The entire building is demolished and a new one is built in its place.
  • The new building is usually taller and includes more apartments.
  • Residents move out temporarily, with housing paid for by the developer, and return when the new building is finished.

Pinui Binui – Rebuilding Whole Neighborhoods

Pinui Binui (which means “Evacuation and Reconstruction”) is a bigger version of urban renewal. Instead of improving one building at a time, entire streets or neighborhoods are demolished and rebuilt from scratch.

  • Everyone moves out while construction happens. The developer pays for their temporary housing.
  • Larger, modern buildings replace the old ones, with better infrastructure, green spaces, and public services.
  • Residents return to brand-new apartments, often bigger than their old ones.

This process takes longer than TAMA 38 because it requires approvals and major city planning, but it transforms entire areas, making them more modern and valuable.
