A guardian, a minor’s parent or an agent under an activated enduring power may need approval for a particular property transaction. Do not assume every case must start in court, or that holding an appointment or power of attorney automatically authorises a sale. Identify the owner, representative, proposed act and applicable approval route first.

Check the role and the actual act

The Administrator General’s financial-transaction service covers specified applications by guardians, parents acting for minors and agents under activated enduring powers. Its 4 August 2025 procedure separates these roles and transactions. Requirements can differ for a sale, purchase, mortgage or tenancy.

Check whether the appointment or power is effective, what it permits, the person’s instructions and wishes where applicable, and any conflict of interest. Activation of an enduring power and approval of a property transaction are separate questions. Our enduring-power guide explains the planning and activation stages.

The Administrator General and court are different routes

The procedure provides for administrative decisions, possible conditions and referral to court in specified circumstances. Some matters remain for the court. Do not substitute a parent’s consent for the necessary approval or apply a rule about a minor’s inheritance waiver to a different estate agreement.

Ask the responsible professional which route applies to the precise act and why. Confirm the current service requirements rather than relying on an older form or the assumption that every transaction follows the same sequence.

Build the application around the proposed transaction

  • Identify the property and exact interest being acquired, sold, mortgaged or let.
  • Gather the representation instrument, effective appointment or activation evidence and relevant restrictions.
  • Ask which rights records, draft terms, valuation, financing information and supporting explanations are required.
  • Explain how the proposed arrangement affects the represented person’s housing, funds and obligations.
  • Identify any related party or competing interest for the lawyer and authority to assess.
  • Keep the application, document requests, decision and evidence of meeting its conditions together.

This is a preparation framework, not a universal official checklist. Obtain the current document list for the actual application and provide accurate information. A previous approval for another act is not proof that this transaction is covered.

Coordinate approval with the contract

Ask the lawyer to map the proposed marketing, signing, payment, possession and registration stages against the approval requirements. Do not infer either that all marketing is prohibited until a court decision or that a binding contract may safely be signed while approval is unresolved.

Read the actual decision and any conditions before treating approval as complete. Confirm who signs, which version of the transaction is authorised and whether a change requires further approval. An administrative approval is not a determination of every tax relief, lender requirement or property defect.

This is general information, not legal or tax advice; confirm with a licensed professional. Procedure reviewed 1 November 2026; check the current route and requirements when applying.

For a co-owned property, start with the ownership and signing-authority guide. Establish the authorised contact and safe transaction timetable before arranging an ordinary sale process.
