Do I Need Permission to Remove a Tree in Israel?

Before removing or relocating a protected or qualifying mature tree in Israel, check whether a forestry licence is required. Private ownership of the garden is not a general exemption. A building project, a safety concern and ordinary garden work can follow different application and evidence requirements.

Use the current official service and the forestry officer responsible for the exact location. Identify the tree species, condition, site and proposed work before deciding that an exception applies. An application, an arborist’s recommendation and a licence in force are different things.

Choose the application route for the actual work

The Agriculture Ministry provides separate services for requests outside construction or development and construction and development requests. Check which applies, who is authorised to submit and which officer handles the location.

Prepare the property and applicant details, location and photographs, explanation of the proposed work and the professional evidence requested. A shared-property tree also requires checking the authority and consents for the application. Do not assume that one apartment owner, tenant, gardener or contractor can authorise the work on behalf of everyone.

Exemptions are conditional

The official 2023 exemption order distinguishes specified orchard, residential-palm, nursery and listed-species circumstances. It contains exclusions, including protected trees, and some species provisions depend on the defined geographic area. An exception for agricultural continuity is not a general exemption whenever agricultural land is involved.

Have the current applicable rule checked for the exact species, use, preservation status and parcel. A broad regional map or a familiar common tree name is not enough. This guide does not determine whether any particular garden or tree is exempt, and it does not provide a current exhaustive species list.

A permit or urgent concern does not settle every question

Check tree requirements alongside the building plan, permit and property rights. Do not assume that approval of building work also authorises every proposed tree removal. Ask the relevant planning and forestry authorities how the requirements fit together for the project.

If the tree presents an immediate danger, contact the responsible emergency or municipal service and obtain the appropriate professional and authority instructions. Do not infer an emergency exemption from an inconvenience, an unsupported safety claim or a contractor’s preference.

Read the decision before scheduling work

Obtain the actual decision and check the tree, location, authorised action, effective date, duration and conditions. Replacement planting, payment or a guarantee may be required. Approval to relocate is not permission to dispose of the tree, and a submitted application is not approval.

Confirm current fees and any additional obligation through the official service. Keep the decision and evidence of compliance with the property file. Do not schedule irreversible work merely because someone says the request is likely to be approved.

Objecting or challenging a decision

If you want to challenge a decision, obtain the published licence or refusal and ask immediately which objection or review route applies, to whom it must be sent and the operative deadline. The route depends on the issuing authority and decision. Do not rely on an old contact list or assume a complaint automatically stops the work.

Keep the decision, publication date, photographs, grounds and submission confirmation. Obtain legal advice if urgent protection or a further court step is needed. The legal-aid and complaints guide explains why an administrative complaint and a legal remedy are different.

This is general information, not legal or tax advice; confirm with a licensed professional and the responsible forestry officer. Current authority instructions and the applicable law control the individual case.
