An Israeli warning note (הערת אזהרה, he’arat azhara) records a written property commitment in the Land Registry, known as Tabu. After a purchase agreement is signed, the entitled party or the person making the commitment can apply to register the note, with the legally required supporting documents and verified signature. It protects against some conflicting later registrations but does not transfer ownership or replace due diligence. A lawyer commonly makes the application through the Land Registration and Settlement Authority’s official warning-note service. The precise process depends on the registered right, the agreement, other notes and whether the property is even registered in Tabu.

What does a warning note actually do?

Under section 126 of the Land Law, a registrable note reflects a written commitment by the owner or another qualifying right-holder to carry out, or refrain from carrying out, a transaction. The right-holder may have committed through a contract, an irrevocable authority or another writing. The person bound by the commitment and the beneficiary are not always the same party.

Section 127(a) normally prevents registration of another transaction inconsistent with the note while it remains registered, unless the beneficiary consents or a court orders it. Section 127(b) also addresses subsequent attachment and insolvency events, with express legal qualifications. These protections matter, but they are not a clean-title guarantee: prior mortgages, an earlier competing claim, the scope of the commitment and other defects still require investigation.

What a Tabu warning note can and cannot establish
Question What the note helps with What still needs verification
Could the seller register a conflicting later sale? A note under section 126 normally blocks an inconsistent registration without the beneficiary’s consent or court order That the note was actually registered on the correct property and right
Does the buyer already own the apartment? No. A warning note records a commitment, not the completed ownership transfer Final conveyance, taxes, approvals and registration of title
Does the note remove existing mortgages or liens? No. It is not a payoff or cancellation of other encumbrances All current registered interests, agreed discharge documents and priority
Does it prove the property complies with planning law? No. It is not a building permit or planning certification Permit drawings, actual use, planning records and registration plan

A buyer should obtain a current Land Registry extract (nesach Tabu) both before relying on the agreement and after registration, to check the relevant names, block, parcel, sub-parcel and recorded notes. An extract is not automatically free. Ask the conveyancing lawyer to explain every entry that affects the deal.

The four applications listed by the Land Registry

The official service distinguishes procedures; calling every register entry a standard buyer’s warning note creates mistakes. Select the correct route before preparing the documents.

Registry service routes, checked 31 October 2026
Official procedure When it may be relevant
Warning note or note requiring consent, sections 126/128 A signed undertaking to transact or not transact, or a separate legal need for third-party consent
All-parties undertaking or TAMA 38 project The specified registration form for an agreement of all parties or certain urban-renewal arrangements
Undertaking to register a mortgage When the agreed financing structure requires that type of note before the mortgage itself is registered
Cancellation of a warning note After the legal basis for cancellation has been documented and the correct consent or authority supplied

Use the Ministry of Justice service to choose the procedure that matches the instrument and the register. A note requiring consent under section 128, a guardianship entry, a court order and an attachment are not interchangeable; not every type is registered or removed under the same rules.

How to register a warning note, step by step

  1. Identify the actual registered rights. Start with a recent Tabu extract, the exact property identifier and the registered right-holder. If the property has no matching Tabu title, do not assume this procedure works.
  2. Confirm the written commitment. The registration is based on an undertaking fitting section 126 or another listed statutory route. The registry application and the contract must refer to the same rights.
  3. Prepare the verified application. Regulation 21 of the Land Registration Regulations provides for an application signed by the person making the commitment or its beneficiary and authenticated by a lawyer or registrar, with the required undertaking and other supporting documents. It is inaccurate to state that buyer and seller must always both sign every ordinary application.
  4. Resolve additional consent requirements. If the person making the commitment is not the registered holder, regulation 21 can require the registered holder’s verified written consent. The lawyer should also check mortgages and other entries that may affect the proposed note.
  5. Submit through the correct channel. The authority offers an online filing route and an appointment-based office route. Check current eligibility, identification and submission instructions on the service itself instead of relying on an old office-hours screenshot.
  6. Pay the applicable government charge. The official 2026 Land Registry fees are below. The number of parcels and kind of request can affect the charge; professional fees are separate.
  7. Read the result back. Obtain the accepted registry result and a new extract to verify the precise note and its beneficiary. A submitted application is not the same thing as a registered note.

How much does registration or cancellation cost in 2026?

The 2026 Land Registry fee notice became effective on 1 January 2026. It replaces figures from old articles that still describe 2020 fees. These are government registry charges, not lawyer or brokerage charges, and the service’s parcel-specific rules can change the payable total.

If the note covers property distributed across multiple parcels or involves a different category of application, ask the registry or your lawyer to calculate the applicable fees from the current notice. Do not substitute an undated figure from a commercial blog.

How do you cancel the warning note?

Cancellation is a separate registered operation. For notes under sections 126, 128 and 129, section 132 of the Land Law allows removal following a court order, or where the registrar is satisfied that the interested parties consent, or that the basis for the note has ended subject to advance notice and a reasonable opportunity to turn to court. A note registered pursuant to a court order under section 130 has a different cancellation rule and requires a court order.

A completed sale does not mean a lawyer may silently remove the buyer’s protection early. Check the contract’s cancellation mechanics, the identity of the beneficiary, any lender instructions and the exact evidence required. After cancellation, order a new extract; an emailed statement saying a note will be cancelled is not proof that it has disappeared from the register.

What if the apartment is not yet registered in Tabu?

This is the most important exception for buyers of some new or unregistered housing. The Israel Land Authority expressly states that it will not permit registration of warning notes or liens on rights that have not yet been registered with the Land Registry. A housing company, a leasehold arrangement, or a development in which rights are administered outside the final Tabu entry may require a different protection and documentation route. It is misleading to describe an unidentified company register or pledge as automatically having exactly the same effect as a section 126 warning note.

Before transferring funds, give the lawyer the current rights certificate, the seller’s chain of rights and the developer or housing-company documents. Ask which binding protections apply to the actual ownership structure and how priority will be established. The Israel Land Authority registration guidance is the official starting point for ILA-managed rights; it does not replace the case-specific legal check.

Buyer and seller checks before money moves

  • Read the current extract: who owns the recorded right, and what prior mortgages, attachments, restrictions and notes remain?
  • Confirm that the proposed note’s beneficiary and property identifiers exactly match the signed transaction.
  • Set the contract’s timing for application, accepted registration, payment release and handling of a registration refusal.
  • Distinguish submission, registry acceptance and final ownership transfer; keep each confirmation separately.
  • Ask what will happen to the note if the sale is cancelled, financing falls through or completion is delayed.

This framework is a practical document-control check, not a substitute for a title opinion, a current extract or an independent building review.
