VAT, called Ma’am in Hebrew, can apply to Israeli property transactions. A developer’s new-home sale is commonly taxable, while a private resale is often outside VAT. The transaction, the parties and statutory exemptions all matter; some real-estate transactions involving a private seller can have VAT consequences. It sits inside our guide to buying property in Israel, next to purchase tax and agent fees.

What is the VAT rate on Israeli property?

The rate is 18% as the standard VAT rate, checked on 2026-10-18. It rose to that level on 1 January 2025, as reported by VATupdate in December 2024. Before that date the rate was 17%.

The seller is only part of the test. Check the nature of the transaction, the property and its use, both parties, and any applicable exemption. The Tax Authority describes one case in which a registered company buying a home from a non-dealer must self-invoice VAT. This does not mean that every private resale is taxable.

When do you pay VAT on Israeli property, and when not?

A developer sale and a taxable commercial sale commonly attract VAT. A private resale is often outside VAT, and qualifying residential rent can be exempt. The table gives starting points; confirm the actual transaction before relying on them.

Deal type Seller VAT applies? Where it sits
New apartment Developer (business) Commonly taxable Confirm whether the quote includes VAT
Resale home Private individual Often outside VAT Check the parties and transaction
Commercial unit Business or company Often taxable Check the transaction and quoted price
Long-term residential rent Landlord May be exempt Check the statutory conditions
Short-term or hotel rental Operator Can be taxable Check the activity and dealer status
Agent or lawyer fees Service provider VAT may apply Confirm whether the quote includes VAT

Do you pay VAT on a new build?

A new home from a developer is commonly sold with VAT included. Ask the developer to confirm the quoted price and tax treatment in writing. A private resale is often outside VAT, but its facts and the parties still need checking.

That is the biggest tax gap between the two routes. It changes the real cost of the same square metres, because part of a new-build price goes to the state and not to the property.

Do you pay VAT on a resale apartment?

A normal private-to-private resale is often outside VAT. Check the facts and the buyer as well as the seller: certain transactions involving a private seller can have VAT consequences. VAT may also apply to agent and lawyer fees, and purchase tax is a separate question. For what those fees usually look like, see standard real estate agent fees in Israel.

How do you work out the VAT slice inside a new-build price?

Divide the VAT-inclusive price by one plus the rate, then subtract. For this illustration, assume a developer asks 2,360,000 NIS for a new apartment, including VAT at 18%. This is not a quote.

  • Pre-VAT price: the VAT-inclusive price divided by 1.18 = 2,000,000 NIS.
  • VAT inside the price: 2,360,000 – 2,000,000 = 360,000 NIS, which is the rate applied to 2,000,000.

So on that headline number, 360,000 NIS is tax going to the state. If a resale at the same price is outside VAT, the calculation differs. Confirm the actual tax treatment and compare the whole cost of each deal.

When do you pay the VAT on an off-plan apartment?

Developer payments are often made in stages. The applicable VAT rate depends on the statutory tax point and the transaction facts. Ask the developer and a tax adviser how a rate change affects each payment.

That staged rule matters when rates move. When the rate rose on 1 January 2025, the treatment of staged payments depended on the tax point and the transaction. Here is an illustrative example: a 2,000,000 NIS (pre-VAT) new build, paid half before the 1 January 2025 rise from 17% to 18% (VATupdate, December 2024) and half after.

  • First 1,000,000 NIS at 17%: 170,000 NIS of VAT.
  • Second 1,000,000 NIS at 18%: 180,000 NIS of VAT.
  • Total VAT paid: 350,000 NIS, against 360,000 NIS had the whole price been at the 18% rate in force from 1 January 2025 (VATupdate, December 2024).

The illustrative 10,000 NIS gap assumes those payments have the stated tax points and rates. The outcome for an actual contract depends on the statutory rules and transaction facts.

Does VAT apply to commercial property?

A commercial property sale by a business is often taxable, but the transaction must be checked. A registered buyer may be able to claim input VAT; eligibility depends on the intended taxable use, documentation and other legal conditions. It is not automatically recoverable.

A person buying a home for private use will generally not be able to recover its VAT as business input tax; check any business-use claim with a tax adviser. Commercial deals are often quoted “plus VAT” and new homes “VAT included”, but confirm the actual quote. For how commercial deals are structured, see our guide to commercial real estate in Israel.

Is residential rent exempt from VAT?

Qualifying residential leases of no more than 25 years are generally exempt from VAT, subject to the statutory conditions. Hotel accommodation is excluded. Check the actual arrangement and use.

Short-term holiday accommodation can be taxable. The activity and dealer status need separate review; turnover alone does not settle every VAT question. Planning, municipal licensing and arnona must also be checked separately. VAT is also a separate question from income tax on the rent. Rental income is taxed under one of three income tracks, covered in the selling and gains family of pages and the rental income guide.

What exceptions and special cases come up?

  • Fees: VAT may apply to agent fees, lawyer fees and developer extras, including on a resale. Confirm whether each quote includes it.
  • Short-term lets: VAT can apply to holiday accommodation; check the activity, registration and transaction.
  • Selling side: what VAT means when you are the one selling a property is covered in VAT when selling property in Israel.
  • Business buyers: input VAT recovery depends on taxable use, proper documentation and other conditions.

How does VAT fit with the other taxes you owe?

VAT is one of several taxes on an Israeli deal and it replaces none of them. On a new build you can owe VAT (inside the price) and purchase tax (on top). Here is the short map so you do not count anything twice.

  • VAT (Ma’am): often included in a taxable new-build price; check the transaction and quote.
  • Purchase tax (Mas Rechisha): potentially payable by buyers of new and resale property, subject to rates, exemptions and reliefs. Investors and most foreign residents start at 8%. The bands are in our purchase tax guide, and the resident and non-resident gap is in the foreign-buyer rates page.
  • Capital gains (Mas Shevach): generally assessed on the seller’s taxable gain, with rates and relief depending on the circumstances. See capital gains tax on Israeli property.

The purchase-tax schedules change, so read them from the official notices: the Tax Authority notice of 12 October 2026 and Tax Authority instruction 1/2026. Eligibility for relief must be assessed separately for each buyer.

What do the official sources say?

The 2025 rate rise is documented by VATupdate. The PwC Tax Summaries cover how Israel taxes individual and rental income, and Kol Zchut explains how purchase tax is calculated. Neither replaces the Tax Authority’s own guidance for your case.

What needs a professional before you sign?

  1. Ask about the seller, buyer, property use and nature of the transaction. Have a tax adviser confirm whether VAT applies and who must account for it.
  2. On a new build, get written confirmation that the quoted price is “VAT included”, and ask how the applicable VAT rate will be determined for each instalment.
  3. If you plan short-term lets, have a tax adviser check the activity, registration requirements and VAT treatment before you start.
  4. Have a licensed Israeli tax lawyer confirm your VAT, purchase tax and later capital gains position together. Rates change and your case may differ.

Which tool should you use?

Use the Tax Authority’s own services and the Kol Zchut purchase tax calculation for the other taxes. For the total cost of a purchase, including VAT on fees, start from the total cost of buying a house in Israel.
